1. Nature of This Platform — Free & Pro

The TrudyINV Enterprise Portal ("Platform") is a self-service portfolio analysis and financial planning tool. All outputs — including portfolio gap analysis, ideal allocation models, future value calculations, Monte Carlo probability scores, goal projections, rebalancing suggestions, portfolio commentary, and PDF reports — are based solely on data entered by the user or fetched with explicit user consent via the Account Aggregator framework, and are produced by automated mathematical models.

The Platform does not constitute personalised investment advice, a solicitation to buy or sell any security, or a recommendation of any specific financial product. TrudyINV Services LLP is not a SEBI-registered Investment Adviser (RIA) and does not provide regulated investment advisory services through this Platform on either the Free or Pro plan.

2. No Guarantee of Accuracy or Outcomes

All projections, allocations, probability scores, and future value estimates are illustrative in nature. They do not account for changes in market conditions, tax implications, personal financial circumstances, inflation variability, charges, or any other factor that may affect actual investment outcomes.

Past performance is not indicative of future results. Investments in securities markets are subject to market risks. Please read all scheme-related documents carefully before investing.

For Pro users: while portfolio data fetched via AA is sourced from regulated FIPs, TrudyINV does not verify this data for accuracy. Portfolio analysis generated from AA data carries the same illustrative nature as manually-entered data. Discrepancies between AA data and your actual holdings should be verified directly with your financial institution.

3. Limitation of Liability

To the fullest extent permitted by applicable law, TrudyINV Services LLP shall not be liable for any direct, indirect, incidental, consequential, or punitive loss or damage of any kind, including but not limited to financial loss, arising from:

• Reliance on any output, analysis, or projection generated by this Platform
• Errors or omissions in user-entered data or AA-fetched data
• Interruption, unavailability, or malfunction of the Platform, Setu, or Razorpay
• Any investment decision made on the basis of Platform outputs
• Unauthorised access to or alteration of user data
• Failure, error, or delay in AA data fetching from FIPs
• Subscription billing issues arising from payment gateway failures

The user expressly agrees that use of this Platform is entirely at their own risk.

Platform outputs are not a substitute for advice from a qualified SEBI-registered Investment Adviser, tax consultant, or legal professional. Users are strongly encouraged to consult a registered investment adviser before making any investment decision. TrudyINV Services LLP recommends that users seek independent professional guidance tailored to their specific financial situation, tax position, dependants, liabilities, and objectives.

5. Account Aggregator Data Disclaimer Pro

• Read-only access: TrudyINV cannot execute any transaction, trade, or financial operation on your linked accounts. Access is strictly limited to viewing portfolio data for analysis purposes.
• Data accuracy: Holdings data is sourced from your financial institutions (FIPs) via Setu. TrudyINV does not verify, validate, or modify this data. Inaccuracies in FIP data may result in inaccurate portfolio analysis.
• Consent is yours to control: You may revoke AA consent at any time. TrudyINV is not responsible for how revocation affects your portfolio data within the Platform.
• No liability for FIP data: TrudyINV is not responsible for errors, omissions, delays, or unavailability of data from any FIP (bank, CAMS, CDSL, NSDL, or insurer).
• Regulatory framework: AA data sharing operates under RBI's Master Directions on Account Aggregators. TrudyINV acts as a Financial Information User (FIU) in compliance with applicable RBI guidelines.
• Portfolio analysis only: AA data is used exclusively for portfolio gap analysis and goal tracking. It is not used to create credit profiles, insurance underwriting, or any other financial assessment.

6. Subscription & Payment Disclaimer Pro

• Subscription fees are for technology access only and do not constitute payment for investment advice, portfolio management, or any SEBI-regulated service.
• No refund for market outcomes: Subscribing to Pro does not guarantee any investment outcome. Pro subscription fees are non-refundable based on portfolio performance.
• Payment security: TrudyINV does not store your card or bank details. All payment processing is handled by Razorpay in compliance with PCI DSS standards.
• GST: All Pro subscription prices are exclusive of GST at 18%. The total amount charged includes applicable GST as per Indian tax law.
• Cancellation: Cancelling a subscription stops future charges. No refund is provided for the current billing period. See Terms & Conditions Section 6 for full refund policy.

Key data practices:

• Data collected: Name, email, profile data, portfolio data, AA-fetched holdings (Pro), mobile number (Pro, AA only), subscription status
• Purpose: Solely to provide the features you request within the Platform
• Third-party sharing: We do not sell or share your personal or financial data for commercial purposes. AA data is shared only with Setu as required for the AA consent mechanism
• Storage: AWS RDS with encryption at rest (AES-256). AA financial data additionally encrypted with AES-256-GCM
• Transit: All connections encrypted via HTTPS/TLS 1.3
• Retention: Account data retained while active. AA data retained up to 6 months per consent. Payment records retained 7 years per GST requirements
• DPDP Act: You have the right to access, correct, and request deletion of your data. Email uday@trudy.in with subject "Data Rights Request"
• Cookies: Session authentication tokens only. No advertising or tracking cookies

This Disclaimer is governed by the laws of the Republic of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka.

TrudyINV Services LLP reserves the right to update this Disclaimer at any time. Material changes will be notified to registered users by email. Continued use of the Platform following any changes constitutes acceptance of the revised Disclaimer.
